1.1 Preamble

These general terms and conditions of sale apply exclusively between VAN V SAS (trade name LABELLE), 176 rue de Grenelle, 75007 - Paris, France, with a capital of €4,100 (hereinafter referred to as "We") and any person visiting or making a purchase via the en.lab-elle.com website. (hereinafter "You").

Any Internet user may consult the General Terms and Conditions of Sale on the en.lab-elle.com website (hereinafter referred to as the "Site"). These general terms and conditions of sale may be subject to change, and the applicable terms and conditions are those in force on the Site at the time you place your order.

Article 2 : Contract

2.1 Conditions for placing an order

- You declare that you are a natural person, at least 18 years old and have the legal capacity or parental authorization to place an order on the Site.

- You are acting for your own personal needs

- You unconditionally accept these terms and conditions

If one or more of these three conditions is not met, you are not authorized to use this site and place an order.

2.2 How to order

Once you have placed your order, we will send you a confirmation e-mail. Once the order has been dispatched, we will inform you of the shipment of your products.

The parcel containing your order will include a delivery note to be sent back to us if you wish to return the jewelry ordered within 14 days. The jewelry must not have been worn or damaged, otherwise the return will not be accepted.

Article 3 : Prices, availability, delivery and customs

3.1 Prices

The prices displayed on the site are indicated in euros, inclusive of all French taxes (European VAT and other applicable taxes), including the cost of processing your order and the cost of packaging, in which each piece of jewelry ordered will be delivered.

You are responsible for shipping costs up to €49; for orders over €50, we offer free shipping.

We reserve the right to modify our prices at any time without notice. Products already ordered will be invoiced according to the rates in effect at the time your order is placed.

Despite our best efforts, it is possible that a number of products on our Site contain a pricing error. In this case, we will inform you and cancel your order unless you choose to accept the order at the new price.

3.2 Availability and delivery

We inform you of the standard delivery date on the Site on the information page for each product. This date is an estimate. In the event of a delay, you will be contacted by e-mail and/or telephone as soon as we have this information.
In the event of a change of size or reference once your initial order has been validated and paid for, the delivery date indicated at the time of your purchase and in your account is no longer valid and will have to be re-evaluated by customer service once your request for modification has been taken into account by the latter. We cannot guarantee delivery on the date linked to the first choice of jewel, since a change of reference or size will cause a delay in the usual shipping or manufacturing process.

If you choose to pay by bank transfer, your order will only be processed on receipt of payment, and the delivery date will be delayed accordingly.

If, despite our best efforts, a product cannot be delivered, we will inform you by e-mail and/or telephone as soon as possible in order to find a satisfactory solution to the problem, without this giving rise to any compensation other than reimbursement or exchange of the order for another product.

3.3 Customs duties for the European Community

As orders are dispatched from France, no customs duties apply to deliveries within the European Community.

3.4 Customs duties for countries outside the European Community

Deliveries outside the European Community are subject to local taxes, customs duties or customs presentation fees. You are responsible for these charges. It is not possible to predict the exact total amount of these charges, as they depend in particular on the value of the shipment. Refusal to pay local taxes, customs duties or customs presentation fees will result in a recall of the order in France and cancellation of the order.

Article 4 : Payment

4.1 Payment options

You can pay by Visa/Mastercard, Paypal or bank transfer.

For the latter, the payment details (IBAN, amount, reference to be specified, etc.) are indicated in the order confirmation email and in your customer account, and must be scrupulously respected for the order to be processed.

4.2 Refusal of payment and order cancellation

For security reasons, we reserve the right to refuse payment and cancel orders:

- for cards issued by banks domiciled outside the European Union

- for bank transfers from banks outside the European Union

- for non-referenced delivery addresses, hotels or P.O. boxes

- if we are unable to contact the person who placed the order

- for any doubt about the validity of the order

Article 5 : Returns and refund of the difference

5.1 Situation giving rise to a return

Three situations may give rise to the return of your product for reimbursement:

- Your statutory right of withdrawal of fourteen (14) days to return items to us without giving any reason

- In the event of delivery of an item which does not conform to your order or which has been damaged in transit, subject to the item being returned to us.

- Up to 14 days after dispatch of your order, we give you the opportunity to return any products ordered which do not give you complete satisfaction, for reimbursement or exchange. After 14 days, no exchange or refund will be accepted.

In the case of an order for several products, the 14-day period for notifying withdrawal does not begin to run until receipt of the last product delivered. Returns do not apply to :
- products that have been personalized at your request (personalized products or products for which you have requested a specific quote).

5.2 Return acceptance conditions

Up to 14 days after your order has been dispatched, we give you the opportunity to return any products that you are not entirely satisfied with for a refund or exchange.

In both cases, for the return to be accepted:

- the products must be returned to us in suitable packaging, must not have been worn or damaged, and must be accompanied by the delivery note provided when your order was dispatched.
For earrings, the complete pair must be returned, along with the chains and pendants sold together.

- an expert appraisal will be carried out to confirm the condition of the returned jewelry.

- you are responsible for return shipping costs.

5.3 Refund procedure

We will issue a refund within 7 days of receipt of the product(s), less any discounts, promotions or vouchers you may have received with your order.

The refund period runs from the date on which we collect the goods.

You will be reimbursed via the payment method you used to make your purchase (credit card, Paypal or bank transfer) and only for the account of the person who made the payment.

Article 6 : Warranties and liability

6.1 Warranties

You benefit from the provisions of the 2-year legal warranty for hidden defects.

In addition, for a period of 2 years from delivery, products are guaranteed against defects in materials and workmanship.

We undertake to exchange the defective product(s) you return to us during this period.

However, this guarantee will only be granted if :

- the defect does not result from abnormal or non-conforming use, an accidental event or an external cause (such as the intervention of any unauthorized third party on the product)

- your jewelry is subject to normal wear and tear or aging;

You are responsible for all shipping and return costs.

Beyond the 2-year warranty period, repairs are possible. For this, please contact customer service.

6.2 Liability

We decline all responsibility in the event that the item delivered does not comply with the legislation of the country of delivery outside the European Union.

We undertake to take all the care customary in the profession for the implementation of the service offered to the customer. Nevertheless, we shall not be held liable in the event of failure to meet our contractual obligations as a result of an act of God or force majeure as defined by the jurisprudence of the French courts.

Furthermore, we shall not be held liable for any insubstantial differences between the photos, texts and illustrations presenting the items on our site and the items ordered.

We use our best endeavors to provide the services described in these General Terms and Conditions of Sale. We are liable for any direct and foreseeable damage at the time of the use of the Site or the conclusion of the sales contract between us and you, however this compensation may not exceed in any case the amount of Your last purchase.

In no event will we be liable for loss of profits, loss of business, loss of data or loss of revenue or any other indirect or consequential damages that were not foreseeable at the time of use of the Site or the conclusion of the sales contract between us and you.

Article 7: Reservation of title

The goods delivered remain our property until they are dispatched to the carrier, once you have paid for them.

Article 8: Site access and property rights

We grant you access to and use of the Site for your personal use.
Under no circumstances are you authorized to download, reproduce, copy, sell, exploit or modify all or part of this Site (in particular listed products, descriptions, prices, downloading or copying of information, use of data, software, sound extracts, graphics, images, texts, photographs, tools) without our express written authorization.

The Site may contain links to other sites on the Internet. These other sites are not under our control, and we cannot be held responsible for the accuracy, intellectual property rights, legality, decency or any other aspect of the content of these sites.

In accordance with the provisions of the EU General Data Protection Regulation of May 25, 2018, we are committed to protecting your personal data.
The company VAN V SAS is responsible for collecting this data. All personal data concerning you that we have collected is treated with the strictest confidentiality. Your personal data, which we collect from the elements you enter, are used exclusively to process your order in the best possible conditions and to provide you with suitable offers. Your personal data will never be rented, transferred or sold to third parties, for any purpose other than the execution of your order, the collection of your feedback on your purchasing experience and/or the sharing of promotional offers from VAN V / LABELLE.

9.1 For site visitors

In order to serve you better, we measure the number of pages viewed, the number of visits, as well as visitors' activity on the site and their frequency of return. On our website, we offer you the opportunity to subscribe to our newsletter. The processing of your electronic contact data is based entirely on your consent. To unsubscribe, please contact our Data Protection Officer or Customer Service. You can also click on the unsubscribe link at the bottom of each of our newsletters.

9.3 For site customers

If you place an order on our website, we process the data required for the execution, conclusion or termination of the order. After placing an order, we will send you a confirmation. You will also receive emails regarding changes to the status of your order. We store the data recorded for the purpose of fulfilling the contract until the expiry of the statutory or, where applicable, contractual warranty and warranty claims. After the expiry of this period, we retain information relating to our contractual relationship as required by commercial and tax law for legal periods. During this period (generally ten years from the conclusion of the contract), the data may be consulted by the tax authorities in the event of an audit. If you have selected a method of payment other than bank transfer, we will pass on your required payment details to a payment service provider that we commission. Article 10: Applicable law and jurisdiction

The present terms and conditions of sale are subject to French law.

All disputes relating to the commercial relationship between you and us are subject to the jurisdiction of the French courts.
